On January 4, Nicolás Rocca, 33, drives his car in Punta del Este in which I was traveling with four other people when hit a Ford K in which there were four girls, two of them failed on the spot. Those who were with Rocca survived. On Thursday, February 16, Rocca was charged and detained, since he was placed in pretrial detention.

The imputation is the first step to lead to the trial, but it does not mean that the accused is guilty, however, preventive detention can be applied when there is a risk of flight or when the person may affect the judicial process.
Miguel Ángel Rocca, is a film producer and for 25 years he has been a Script teacher at the University of Buenos Aires and director of the Eliseo Subiela Professional School of Film and Audiovisual Arts. He had remained silent at the request of his son, but now he felt the need to speak because of the series of injustices that he perceived in the treatment of the case.

“Nicolás was arrested in a totally irregular way, especially taking into account that it is a crime classified as culpable, which means that there is no intentionality”, he clarified. “The prosecutor sees the possibility of taking refuge harshly in that Nicolás is a foreigner, that is discriminatory, but in this case Nicolás’s lawyers demonstrated the roots, because Nicolás has been here in Uruguay for 45 days, we had to rent a house for a year to accompany him in the process and, in addition, Nicolás can continue working remotely and I, who am the father, have been working in Uruguay for 10 years, that is, there is no justification for uprooting”, explained Ángel Rocca. On the other hand, the possibility of interfering in the judicial process does not apply either, because Nicolás was free until last Thursday, so if he had wanted to do something he could have done it.
“The lawyers found absolutely no answer, but the judge allowed it and they took Nicolás prisoner,” said his father, very concerned.
Ángel Rocca also recounted that his son suffered the total destruction of his bladder and that he is under medical and psychiatric treatment. “He is undergoing post-traumatic psychiatric treatment, because after the accident he really had a very deep acute depression, normal for these cases,” he specified.
The fatal accident on January 4
Nicolás Rocca drove the car in which he was traveling with Josefina Elissondo, Nazarena Sierra, Milena Antún and Juan Centero and collided with the vehicle driven by Josefina Ferrero, who died. Micaela Trinidad was also traveling in that car, who also lost her life and Camila Palacio and Melanie Larraburu who were seriously injured.

Ferrero’s toxicology analysis revealed that she had used cocaine, methamphetamine, ketamine, ecstasy and cannabis, before being involved in the violent collision that took her life. In the blood test of Nicolás Rocca, the presence of morphine was detected, which was administered at the Cantegrill Sanatorium after the accident. Regarding the amount of alcohol, Rocca had a result below 0.10 grams in the spirometer and Ferrero detected 0.39 grams. “Nicolas had consumed only one glass of champagne nine hours before the accident,” his father clarified.
Last Thursday Judge Ana María Guzmán formalized the request for imputation against Nicolás Rocca and was based on the official technical expertise of road accidentology that maintains that the car driven by the young man was the one that invaded the lane of the Ford Ka driven by Josefina Ferrero.
“We have an expertise from a party that says the opposite, we have an accidental report that says the opposite, we have a technical report on the vehicles that says otherwise,” Rocca stressed. “We are convinced that Nicolás did not cross the lane,” she said.
On the other hand, there is a peculiar circumstance that the Rocca family focuses on and that is that Nicolás remembers everything that happened in the accident and he was not allowed to give his statement. “Imagine he lives it in his head, that they never let him speak, he never let him express what he never used and today he is in prison, he is absolutely insane and legally he does not have to be in prison, he has to be at home waiting for the evolution of the process”.
The defendant’s father said that the place where the accident occurred is an area that has a very dangerous blind spot, that does not have the corresponding signage and that, to top it off, none of the four cameras in the area were working.
Nicolás Rocca and the girls who died knew each other
Ángel Rocca recorded a very painful moment when he told his son that the girls had disappeared. Nicolás and the girls had been together at a party and the previous afternoon they had all been in the same house and on the beach. “It’s an accident of people who knew each other a lotWhen we told him that it caused deep depression and anguish, I remember it and I started to cry because it was a tremendous thing,” he recorded.
Pink cocaine and a false witness
“The record of the seizure of the pink cocaine, which was distinguished on all sides, does not specify who it belonged to, and what does the defense attorney for the deceased girls do? He goes to the television channels and says that this bag was found in my son’s car, ”he lamented.
Finally, Ángel Rocca said that there was a false witness. “There is a witness that we have dismissed because it is proven that he lied Why did that witness appear and lie, I would worry, but the Prosecutor’s Office would have to worry much more than me, because there is a person who was declared and lied and later it was discovered that he lied luckily”.
“I am privileged because my son is aliveFrom the first second when I saw the magnitude of what had happened, it was enough for me to think that my son was alive and I take that into account, I have to tell that, but later one has to think about what this has to proceed with honesty, transparency and Nicolás asked us not to, not to answer, not to say anything that things were going to clear up on their own and I think that played against it,” he concluded.
