“Perpetual pain”: Fernando’s parents believe that the judges “fell short with the sentence”

After three years and after meeting the condemns the eight rugbiers for the crime of Fernando Báez Sosahis mother, Grace Sosa, stated: “I felt excitement and peace in my heart. I know who killed my son and now I have a bit of calm.” Despite the initial conformism, the victim’s father announced: “this is just beginning. We want to perpetuate for everyone.”

Even sentences of life imprisonment for Máximo Thompsen, Ciro Pertossi, Enzo Comelli, Matías Benicelli and Luciano Pertossi, considering them criminally responsible co-authors, Silvino was satisfied with the decision of judges María Claudia Castro, Emiliano Lazzari and Christian Rabaia. However, in later statements, Fernando’s father complained about the 15-year prison sentence he received Ayrton Violaz, Blas Cinalli and Lucas Pertossi, for being considered secondary participants in the crime. “I think that with the other three defendants they fell short with the sentence. I was surprised, I expected 25 (years) or life. The doctors are going to appeal and they are going to go to Cassation,” he anticipated.

Regarding the incident, Graciela Sosa said that “there were eight against a defenseless man” and that her son was attacked “as in a ambush, they attacked his person like a hyena.” Fernando’s mother added: “I always keep in mind the way he was kicked and my son’s blood appears on my head, on the shoe, on the clothes. They knew what they were doing, they enjoyed killing my son, calling him a ‘shit black’, that ‘expired’. I have that very engraved in my heart ”.

“Forgiving them is very difficult. They took a son from me who had only gone to have fun. My son came back, but in a closed drawer from which he will never leave again,” said Graciela, adding: “Fernando’s absence is also perpetual and our pain is perpetual, forever”.

At a press conference, Silvino expressed: “I think that they remembered late to repent; I think they are kids, they didn’t know where they were and when they heard the sentence it shows that it decompensates. It’s no joke where they are; As a parent, I can only say that this should be seen before the murder of my son happened.” And he added: “We need a little peace, to recover our spirits because what happened I do not wish on anyone; It was very hard because it was the only one to use and seeing it like this in all the videos is very difficult”.

“I would tell my son that we got what we were looking for, which was justice. We are satisfied with the ruling and Fernando is going to take it with us every day,” Silvino added.

Graciela, who together with her husband participated in all the hearings (except for the day of the forensic report), stressed: “I was always a religious person, but since what happened with my son I clung more to God by praying the rosary. I felt that Fernando from beyond helps me to be strong and to be able to cope with this pain. It is difficult, but I am learning to live with the pain because the truth is that I miss my son a lot.

In the end, Fernando’s mother added: “With the loss of him, all that joy they used left us, many things like parties, Christmas, New Years, Mother’s Day, that mothers always want to hear a ‘ happy day’, an ‘I love you’ or receive a hug. Or his birthday, which he liked so much, that I can’t make him a pancake or say ‘happy birthday’, but we’ll try to move on. On the verge of tears and with a round of applause from those present, Graciela and her husband ended the press conference.

How the case against rugbiers continues

In addition to sentencing the eight rugbiers, the judges upheld the proposal of the prosecution, headed by Juan Manuel Dávila, to establish whether Juan Pedro Guarino and Tomás Colazo committed false testimony. Let us remember that both were not put on trial for the crime that occurred on January 18, 2020 in Villa Gesell, although they gave a statement at one of the hearings.

On the other hand, the eight convicts returned to Melchor Romero waiting for the Buenos Aires Penitentiary Service to decide on their place of confinement. If today’s sentence is upheld, the three sentenced to 15 years must go to a different prison than the other five. Being Máximo Thompsen, Ciro Pertossi, Enzo Comelli, Matías Benicelli and Luciano Pertossi who arrived from the “vacancies” of the Campana or Sierra Chica prison complex.
